أحال نظام الرياضة الجديد المعتمد من مجلس الوزراء تحديد الحد الأعلى لحصة الشريك أو المساهم الأجنبي في الشركات الرياضية إلى اللجنة الوزارية الدائمة لفحص الاستثمارات الأجنبية، المنشأة بقرار مجلس الوزراء رقم (83) وتاريخ 30 / 3 / 1443هـ، باعتبارها الجهة المختصة بتقييم أثر الملكيات الأجنبية في القطاعات ذات الحساسية الإستراتيجية، ومن بينها القطاع الرياضي، الذي يشهد نمواً متسارعاً وتحولاً اقتصادياً كبيراً. ويأتي ذلك ضمن مواد ولائحة نظام الرياضة الجديد، الذي يُعدّ أكبر إعادة هيكلة تشريعية وتنظيمية يشهدها القطاع منذ تأسيسه، والذي حصلت «عكاظ» على نسخة منه.

وتضم اللجنة في عضويتها وزارات الاستثمار، والتجارة، والمالية، والاقتصاد والتخطيط، والموارد البشرية، إضافة إلى البنك المركزي السعودي، والهيئة العامة للمنافسة، مع صلاحية الاستعانة بجهات حكومية إضافية عند الحاجة. ويعكس هذا التشكيل حجم الاعتبارات الاقتصادية والتنظيمية المرتبطة بملكية الأجانب داخل القطاع الرياضي، وأهمية ضبطها وفق معايير وطنية دقيقة.

وبموجب الإحالة النظامية، تتولى اللجنة دراسة المعايير والضوابط المتعلقة بمشاركة المستثمر الأجنبي في الشركات الرياضية، ورفع توصية تفصيلية تُحدّد النسبة القصوى للملكية المسموح بها، على أن يصدر مجلس الوزراء قراراً مستقلاً باعتماد تلك النسبة. ويهدف هذا المسار إلى تحقيق توازن بين تحفيز الاستثمار الأجنبي وحماية مصالح القطاع المحلي، وضمان عدالة السوق الرياضية وتنافسيتها.

ويأتي هذا الإطار ضمن مسار تشريعي واسع يشهده القطاع الرياضي، يستهدف رفع مستوى الحوكمة، وتنظيم بيئة الاستثمار، وجذب الرساميل، وتطوير البنية التنظيمية للرياضة السعودية بما يتماشى مع مستهدفات رؤية المملكة 2030.

The new sports system approved by the Council of Ministers has referred the determination of the maximum share for foreign partners or investors in sports companies to the Permanent Ministerial Committee for Examining Foreign Investments, established by Council of Ministers Decision No. (83) dated 30/3/1443 AH, as it is the competent authority to assess the impact of foreign ownership in sectors with strategic sensitivity, including the sports sector, which is witnessing rapid growth and significant economic transformation. This comes as part of the provisions and regulations of the new sports system, which represents the largest legislative and organizational restructuring the sector has seen since its establishment, a copy of which was obtained by "Okaz".

The committee includes members from the Ministries of Investment, Commerce, Finance, Economy and Planning, and Human Resources, in addition to the Saudi Central Bank and the General Authority for Competition, with the authority to consult additional governmental bodies as needed. This composition reflects the extent of economic and regulatory considerations related to foreign ownership within the sports sector, and the importance of regulating it according to precise national standards.

According to the regulatory referral, the committee is responsible for studying the criteria and controls related to foreign investor participation in sports companies and submitting a detailed recommendation that specifies the maximum allowable ownership percentage, with the Council of Ministers issuing an independent decision to approve that percentage. This process aims to achieve a balance between stimulating foreign investment and protecting the interests of the local sector, ensuring fairness and competitiveness in the sports market.

This framework is part of a broad legislative path witnessed by the sports sector, aiming to enhance governance, organize the investment environment, attract capital, and develop the regulatory framework for Saudi sports in line with the objectives of the Kingdom's Vision 2030.
